COVID-19 Participant Notice, Assumption of Risk and Waiver

The purpose of this document is to provide the undersigned participant and his or her parent or legal guardian with Important Notices related to the COVID-19 and to solicit the undersigned’s voluntary acknowledgement, consent and waiver, related to their participation in activities sponsored and conducted by the Alive Center.

Part I – Important Notices

The undersigned hereby takes notice of the following disclosures (the “Notices”):
Known Risk Factors Related to COVID-19. COVID-19 is a new disease, and as a result, there is limited information regarding risk factors for the disease. The information concerning COVID-19 and the outbreak are unknown and rapidly evolving. There is much more to learn about the transmissibility, severity, and other features associated with COVID-19, and investigations are ongoing. Reported illnesses have ranged from mild symptoms to severe illness and death for confirmed COVID-19 cases. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions might be a higher risk for severe illness from COVID-19.

Many conditions can cause a person to be immune compromised, including cancer treatment, bone marrow or organ transplantation, immune deficiencies, poorly controlled HIV or AIDS, and prolonged use of corticosteroids and other immune weakening medications.

The “Known Risk Factors” related to COVID-19 which are published on the CDC website at www.cdc.gov/coronavirus.

State of Illinois. On March 9, 2020, the Governor of the State of Illinois issued a Disaster Proclamation related to COVID-19.  Subsequently, the Governor issued and continues to issue Executive Orders related to Essential Businesses, Essential Travel and reopening directives. Additional Notices from the Alive Center. In addition to the above, the Alive Center will be providing specific guidance to participants from time to time with respect to policies and procedures to be followed at the Alive Center and while engaging in activities with Alive Center staff and other participants to promote the safety of others.  You agree to take notice of these policies, procedures, and guidelines and to abide by these policies, procedures, and guidelines at all times.  You further agree to notify a member of Alive Center staff immediately in the event you believe that you have any COVID-19 symptoms and you will act immediately and in accordance with published guidelines to limit exposure to others, which guidelines may restrict your access to the Alive Center or its activities.  

Part II –Acknowledgment and Assumption of Risk

The undersigned acknowledges their review of the Notices that have been provided or otherwise published in connection with access to and participation in Alive Center activities, including the full review and understanding of the Known Risk Factors, State of Illinois, CDC guidance set forth and available via the web links above. The undersigned by the execution of their registration for Alive Center camps or drop-in activities and this document also acknowledges (i) the risk of contracting COVID-19 could be greater as a result of their entry into the Alive Center or participation in Alive Center activities; and in the event of entry into the Alive Center facility hereby assumes the risk of contracting COVID-19 and of all consequences of such infection; (ii) all participants at the Alive Center will be expected to follow health and safety protocols related to prevention of COVID-19, including wearing face masks at all times except when eating or outdoors and safely distanced from others.  

The undersigned further covenants and agrees that this Notice, Acknowledgement, Assumption of Risk and Waiver (this “Waiver”) shall be construed, first, in accordance with the laws of the State of Illinois and that any mediation, suit, or other proceeding relating to this Waiver and any activities covered hereby must be filed or entered into only in Illinois and the state courts of Illinois. Any portion of this Waiver deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the Waiver as a whole to the full extent authorized by law.

Part III –Waiver

To the extent permitted by law, the undersigned hereby releases, waives and discharges the Alive Center (“Alive”), its directors, officers, agents, and employees (the “Releasees”) from any and all liability, claims, demands, actions, and causes of action of any kind or nature for any loss, damage, or injury, including death arising out of or related to my entry onto, use of the Alive Center as a participant. It is my express intent that this Waiver bind my family members, heirs, assigns, personal representatives, and anyone else entitled to act on my behalf to the extent they act on my behalf, and is deemed as a release, waiver, discharge, and covenant not to sue the Releasees.
